1. Acceptance of Terms
By accessing or using Growth Fusion AI ("we", "us", "our") services, you ("Client", "you") agree to be bound by these Terms & Conditions. If you do not agree, do not use the services.
2. Services
Growth Fusion AI provides a done-for-you marketing system that includes: Facebook and Instagram ad management, an AI-powered lead follow-up system, an AI booking agent, a landing page, and a CRM/pipeline configured for your business. Specific deliverables and timelines are described on growthfusionai.com.
3. Subscription & Billing
A one-time setup fee of $97 (currently discounted from $997) is charged at signup. The first month of subscription is included at no cost. Beginning Month 2, the subscription fee is $397/month, billed monthly to the payment method on file. Usage charges (AI voice calls at $0.12/min, SMS at $0.03/message, email at $10 per 5,000 sends) are metered from day one and billed monthly. Advertising spend is billed by Meta directly to your card and is not Growth Fusion AI revenue.
4. Cancellation & Refunds
You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the then-current billing period. Refunds, where applicable, are governed by our Return & Refund Policy. The $97 setup fee is non-refundable once the build process has begun.
5. Intellectual Property
Growth Fusion AI retains all rights, title, and interest in and to the proprietary technology, AI models, ad creative, landing page templates, CRM configurations, automations, and any other intellectual property created or deployed in providing the service. Upon cancellation, your access to these assets ends — you do not retain a license to use them. You retain ownership of leads generated during your active subscription; we will provide a one-time export of those lead records on request after cancellation.
6. Usage Policies
You agree to use the service only for lawful purposes and in compliance with all applicable laws including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, GDPR, and any other applicable communications regulations. You are responsible for the accuracy of the offer information you provide and for ensuring you have valid consent to contact the leads generated.
7. Performance Disclaimers
Growth Fusion AI does not guarantee specific lead volume, conversion rates, or booked-call counts. Marketing results depend on market conditions, offer strength, ad spend, and many factors outside our control. Service-level guarantees (7-day launch, 60-second AI response, continuous optimization) are operational commitments — see Section 8.
8. Service Level Guarantees
7-Day Launch Guarantee: your complete system will be live within 7 business days of your onboarding call. Each business day past day 7 reduces your first paid month proportionally until live. Cancel Anytime: you may cancel without contract obligation or penalty at any time. Pricing Transparency: all usage is metered and visible in your dashboard in real time.
9. Limitation of Liability
To the maximum extent permitted by law, Growth Fusion AI's aggregate liability arising out of or related to the service shall not exceed the total fees paid by you in the twelve (12) months preceding the claim. In no event shall Growth Fusion AI be liable for indirect, incidental, special, consequential, or punitive damages.
10. Modifications to These Terms
We may update these Terms & Conditions from time to time. Material changes will be communicated to active subscribers by email at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the revised terms.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which Growth Fusion AI is incorporated, without regard to its conflict-of-law provisions.
